Welcome to In The Act. These Terms & Conditions govern your use of our website (www.theweddingact.com) and our services, including but not limited to photography and videography for weddings and related events. By accessing or using our website or services, you agree to comply with and be bound by these Terms & Conditions. If you do not agree to these terms, you may not access or use our services.
1. Services Provided
In The Act Films offers wedding and event photography and videography services. The scope of services, pricing, and deliverables are agreed upon at the time of booking. Any additional services or requests may incur additional fees, which will be discussed and agreed upon before proceeding.
2. Booking and Payment
a. Booking Process:
To book our services, clients are required to complete a booking form and sign a contract that outlines the services, date, and terms of the agreement.
b. Deposit and Payment Terms:
A non-refundable deposit of 15% is required to secure the booking date. The remaining balance is due on days of the event. Payments can be made via United Bank Limited, Account No. 271713672 in the name of [Muhammad Kamran Ashraf].
c. Cancellation Policy:
If a client cancels the booking, the deposit is non-refundable. Cancellations made 14 days or more before the event may be subject to additional fees. If In The Act Films cancels due to unforeseen circumstances (e.g., illness, emergencies), we will refund the deposit in full or provide a suitable alternative photographer/videographer.
3. Event Coverage
a. Time Allocation:
The client agrees to the time allocation outlined in the contract. Any additional hours requested during the event are subject to availability and will incur an additional hourly rate.
b. Access and Cooperation:
The client is responsible for providing In The Act Films with reasonable access to the event venue(s), along with any permits or permissions necessary for photography and videography. The client must also ensure that all participants and guests cooperate to avoid any disruptions to the service.
4. Deliverables
a. Photographs and Videos:
After the event, the client will receive edited high-resolution photographs and/or videos based on the package selected. The final number of photographs or duration of the video may vary slightly from what is stated in the contract due to event circumstances.
b. Editing:
All images and videos will be professionally edited at the discretion of In The Act Films. Requests for additional edits may incur extra fees. Raw, unedited files will not be provided unless agreed upon in writing beforehand.
c. Delivery Time:
The estimated delivery time for photos is [6-8 weeks, e.g., 4-6 weeks] and for videos is [6-8 weeks, e.g., 6-8 weeks]. In The Act Films will inform the client of any delays due to unforeseen circumstances, such as equipment failure or personal emergencies.
5. Intellectual Property Rights
a. Ownership:
All photographs, videos, and other content produced by In The Act Films are the intellectual property of In The Act Films. The client is granted a non-exclusive license to use the photographs and videos for personal use, including sharing on social media.
b. Usage by In The Act Films:
In The Act Films reserves the right to use photos and videos from the event for promotional purposes, including website galleries, social media, and marketing materials. If the client wishes to withhold permission for such use, this must be communicated in writing before the event.
6. Client Responsibilities
The client agrees to provide accurate and complete information when booking our services. The client is responsible for informing In The Act Films of any key moments or specific shots they wish to be captured during the event. In The Act Films cannot be held responsible for any missed shots if the client fails to communicate these preferences beforehand.
7. Liability
a. Damage to Equipment:
The client agrees to take reasonable steps to protect In The Act Films’ equipment during the event. Any damage caused to equipment by the client, guests, or venue staff may result in additional fees to cover repair or replacement costs.
b. Limitation of Liability:
In The Act Films is not liable for any damages, including lost or corrupted files, missed shots, or delays, beyond the amount paid by the client for the services. In the unlikely event of equipment failure, illness, or other unforeseen circumstances, In The Act Films will make every effort to provide an alternative solution, including offering a refund or rescheduling services.
8. Force Majeure
In The Act Films is not liable for failure to perform its services due to circumstances beyond its control, such as acts of God, natural disasters, fire, flood, pandemics, war, government regulations, or other emergencies. In the event of force majeure, the client will be offered the option to reschedule the services or receive a refund of any payments made, excluding the non-refundable deposit.
9. Changes and Amendments
In The Act Films reserves the right to update or amend these Terms & Conditions at any time. Any changes will be posted on our website, and it is the client’s responsibility to review these terms periodically.
10. Governing Law
These Terms & Conditions are governed by the laws of Pakistan. Any disputes arising from or related to these terms shall be resolved in the courts of Pakistan.
